Delivery Return

Unclaimed products

You have two weeks to pick up your package when ordering a product. If you dont pick up the package within this time, it is automatically sent back to Tenue de Ville’s offices. You will then get a note in the customer register, which means that you may not place any new orders. For orders not picked up that are returned to Tenue de Ville’s offices, you as a customer will receive an invoice for 38,5€. Unpaid invoices are forwarded to a debt collection. We cooperate with the police in case of fraud.

Duty

Possible duty is paid by the customer and not by Tenue de Ville

Freight

All prices are excluding freight. The cost for freight will be added and must be paid by the customer. The freight charges are announced in connection with the order. We ship with BePost and TNT.

Damage to a package

If you discover damage to the package, you must immediately notify the post office or other carrier and make a complaint. Do not collect a damage package! If you do not discover the damage until you opened the package and the damage is of a nature that it can be attributed to the handling of the post office or the delivery company, you should contact them and make a complaint. If a possible dispute with the post office or the delivery company cannot be resolved, please contact us.

Delivery

We do our utmost to lightning fast deliveries if the item is in stock. Expect your delivery within 1 week depending on where in the world you live.

Complaints

If you can prove that there are manufacturing defects on the product, you always get a new product, however this does not apply to damage cause by wearing. You pay the return freight.

Contact contact@tenuedeville.com if you have complaints as soon as you discover the defect. If possible the complaint will be replaced with a new product. If it’s not possible to replace this product or correct the defect, you will get your money back. It will be helpful to add the photos of the defect/damage in the email as this will speed up the process. When we have received the product and the complaint has been approved, we will notify you and send you a new product or refund you within 14 days from that you made your payment.

Return Policy

Tenue de Ville’s return policy means that you can return unused products within 10 days from the date you received the item/items. The products must be returned unused, undamaged and with the labels attached to the item. This also applies to products on sale. Repayment of returned packages must be made within 14 days. 

Remember that Tenue de Ville will not pay for the return freight. Please write your contact details and order description clearly as well as reason of return.

Installation

Hanging Instructions

Hanging Instructions – Digital Wallpaper

Whilst we make every effort to ensure that all our wallpapers and borders are of the highest quality, slight variations in shade or pattern may occur during manufacture. Before cutting and hanging wallpapers or borders, please inspect every roll to ensure that they all have the same batch number, are in good condition, and that the edges match correctly. The company cannot accept any liability for defects in the condition of the product or matching that are apparent at the time of hanging, nor can the company be responsible for any consequential loss. All labels should be retained until hanging is complete and to your satisfaction. 

If your wallpaper is an all-over dark colour, the ends of the rolls should be coloured with a matching crayon or marker to avoid white edges showing.

To minimize the hazard in the event of fire, DO NOT hang wallpapers over expanded polystyrene veneers or any other flammable products, and ensure that wallcoverings are always firmly stuck down.

Preparation: 

Walls should always be clean, firm and dry. Roughen any painted surfaces with
glass/sandpaper. Remove any old wallcoverings, and fill any holes and cracks. Size any absorbent surfaces. Scrape powdery or flaky areas and paint with suitably prepared size, or oil-based primer, allowing it to dry completely.

Lining:

It is important that the walls are cross-lined. Avoid white lining papers for dark wallpapers.

Adhesive:

Ensure that a good quality Paste-the-wall “Tub” adhesive, containing a fungicide, is used with this wallcovering. Try to avoid getting adhesive on the printed surface. If it is unavoidable, gently wipe off with a clean dry sponge whilst it is moist, making sure to rinse it thoroughly throughout the cleaning process, using clear water only, and no soap or cleaning liquids of any kind.

Application:

Cut your lengths allowing for Pattern Matching and for final trimming at the bottom. DO NOT assume that the wallpaper will come off the roll the right way up – this should always be checked. If unsure, consult Tenue de Ville’s website or check with your retailer. Using a roller, apply plenty of paste to the wall, slightly wider than the drop you are about to hang, paying particular attention to the top and bottom. Use a plumb line when hanging the first length and smooth the paper to the wall, using a paperhangers brush, from the centre of the length to the edge, to expel air bubbles. After hanging 3 or 4 lengths, inspect the result to ensure no shading or other faults are present. NO claim for redecorating costs can be allowed. Butt-join subsequent lengths. Good ventilation and an even temperature will assist in the even drying of wallpaper.

Wallpaper care:

This wallpaper has a matt finish, which permits the removal of surface marks by gentlydabbing with a moist sponge. Do not scrub or use any abrasive cleaning agents.

The information given in our specifications or technical / hanging advice, whether verbal or written is for guidance and is given in good faith but without warranty, as site conditions and levels of skill in application are beyond our control. We can accept no liability for the performance of the products arising out of such use, beyond the value of the goods supplied by us

Reservation

Due to the fact that some products are made on order and may have been taken out of production or for any other reason is no longer possible for Tenue de Ville to deliver, orders are not binding for Tenue de Ville until Tenue de Ville has sent an order confirmation to the customer. 

We reserve the right to change prices at circumstances that are out of Tenue de Ville’s control, e.g. currency fluctuations, higher purchasing prices or production prices or increased VAT. We also reserve the right to cancel orders where the product is clearly mispriced. 

Privacy Protection Law

Your personal information is handled in accordance with relevant provisions of the privacy protection law / personal data act.

Pricing

VAT is included in the price with 21% at present date. We reserve the right that it may be incorrect pricing information on the site. For overseas ordes, VAT and customs duties may be added

Products made on order

We have prepayment on products made on order. You cannot cancel a product made on order. The return policy does not apply to products made on order.

1. Toutes les relations commerciales entre la SPRL BELGIAN DESIGN (dénommée ci-après « BELGIAN DESIGN ») et le client, seront régies par les présentes conditions générales. En faisant sa commande, le client reconnaît avoir pris connaissance du contenu de ces

conditions et les accepter. Les présentes conditions générales priment de plein droit les conditions d’achat et/ou autres conditions générales du client, même si celles-ci stipulent qu’elles sont les seules à s’appliquer. La nullité éventuelle de l’une des dispositions des présentes

conditions générales n’aura en aucune manière une influence sur la validité des autres clauses. BELGIAN DESIGN se réserve le droit de modifier les dispositions des présentes conditions générales.

2. Aucune offre faite par BELGIAN DESIGN ne constitue une obligation dans le chef de BELGIAN DESIGN, et toute offre reste valable pendant un mois. Les prix ainsi que les délais de livraison des biens offerts sont purement indicatifs. Une offre faite pour une commande ne

vaut pas automatiquement pour des commandes suivantes. Les prix dans l’offre ne valent qu’en cas de vente de la totalité de la commande.

3. Une convention entre BELGIAN DESIGN et le client ne se réalise que moyennant l’acceptation écrite ou électronique de la commande du client par BELGIAN DESIGN ou par un début d’exécution par BELGIAN DESIGN. Toute modification ou addition éventuelle n’est valable

qu’après l’accord écrit des deux parties.

4. Sauf convention contraire, les produits vendus par BELGIAN DESIGN doivent être enlevés sur les lieux de BELGIAN DESIGN. Tous les frais de réception des produits sont à charge du client. En cas de livraison auprès du client, les risques du transport des produits sont

toujours assumés par le client. Des livraisons tardives ne peuvent pas donner lieu au paiement d’amende, de dommages-intérêts, subrogation ou à la dissolution du contrat à charge de BELGIAN DESIGN. Toute modification de commande annule les délais de livraison

convenus. BELGIAN DESIGN se réserve le droit de facturer des frais de stockage en cas d’enlèvement ou livraison tardive causé par le client.

5. En Belgique, les prix de BELGIAN DESIGN s’entendent (sauf mention contraire) hors TVA et hors frais de livraison, expédition, assurances et administration. BELGIAN DESIGN se réserve le droit d’adapter les prix, en respectant les limites légales, pendant la durée de la

convention, à l’évolution de ses coûts fixes et/ou variables en raison d’un changement de leur structure (matières premières, salaires, énergie, modification de la réglementation, mesures de sécurité, …).Sauf mention contraire sur la facture, toutes les factures sont payables en

euro, net, au siège social de BELGIAN DESIGN dans les 30 jours à compter de la date d’émission de la facture. Un escompte pour paiement comptant ne peut être consenti qu’en cas d’accord préalable et écrit. Le montant de toute facture qui n’a pas été payé à l’échéance,

produira de plein droit et sans mise en demeure préalable, un intérêt égal à 12% par an. En cas de non-paiement à l’échéance, le montant des factures impayées sera majoré de plein droit de 15%, avec un minimum de 75 EUR à titre de dédommagement conventionnel et

forfaitaire, même en cas d’attribution des délais de paiement, sans préjudice au droit de BELGIAN DESIGN à l’indemnisation du dommage plus élevé établi et en compensation des frais (judiciaires) de recouvrement. Dans la mesure où le client s’abstient de régler une ou

plusieurs créances à l’égard de BELGIAN DESIGN, BELGIAN DESIGN peut suspendre les livraisons de produits ou de services ou annuler les commandes non-livrées jusqu’au paiement intégral de toutes les factures dues. En cas de défaut de paiement des factures à

l’échéance, ainsi que des intérêts et clauses pénales éventuelles, toutes les factures, même pas échues, deviennent immédiatement exigibles et les modalités de paiement consenties s’annulent. La même règle s’applique en cas de menace de faillite, dissolution judiciaire ou

conventionnelle, demande de concordat, cessation de paiement, ainsi qu’en cas de tout fait dénonçant l’insolvabilité du client. Si le client persiste à ne pas répondre à ses obligations contractuelles de paiement, pour n’importe quelle raison, BELGIAN DESIGN se réserve le droit

de dissoudre le contrat sans frais et sans mise en demeure ou intervention judiciaire, par simple lettre recommandée adressée au client. Le paiement sans réserve – en tout ou en partie – d’un montant facturé implique acceptation de la facture. Paiements partiels sont toujours

acceptés sous toute réserve en sans aucune reconnaissance préjudiciable, et sont imputés d’abord aux frais de justice, puis aux intérêts échus, puis à la clause pénale et finalement au montant principal. BELGIAN DESIGN a le droit de compenser des créances et des dettes

certaines, exigibles et réciproques qui existent entre elle et le client, à concurrence de la quotité la moins élevée. Cette stipulation est opposable au curateur en cas de faillite du client. Les factures ne peuvent être protestées valablement que par lettre recommandée et dans les

huit jours à compter de la date d’émission de la facture et avec mention de la date d’émission et du numéro de la facture et d’une motivation détaillée.

6. Sauf stipulation contraire, le client transmettra ses plaintes par lettre recommandée à BELGIAN DESIGN, et ce, (a) en cas de plainte pour des vices apparents ou un défaut de conformité, dans les 8 jours à compter de la livraison des produits ou de l’exécution des

prestations, et (b) en cas de vices cachés, dans les 8 jours de la découverte de ce vice et en tous cas dans les six mois à compter de la livraison. Le dépôt d’une plainte ne décharge pas le client de ses obligations de paiement. Aucune responsabilité pour des vices apparents

ou cachés ne pourra être retenue dans le chef de BELGIAN DESIGN si ces délais sont arrivés à expiration sans réception de la lettre recommandée mentionnée ci-dessus. Toute action en réparation ou en garantie s’éteint en outre en cas de transformation, incorporation,

réparation par le client ou par des tiers ou en cas d’usage, charge et/ou usure anormal ou exceptionnel ou en cas de revente des biens vendus. Il est convenu que le bref délai selon l’article 1648 CC est de 6 mois à compter de la livraison des produits.

7. La responsabilité de BELGIAN DESIGN est limitée à la responsabilité que la loi impose impérativement. BELGIAN DESIGN n’est jamais responsable de dommages indirects, tels que la diminution du chiffre d’affaires, le manque à gagner ou toute augmentation des frais

généraux. BELGIAN DESIGN n’est pas non plus responsable des vices causés de manière directe ou indirecte par un acte du client ou d’un tiers, qu’ils aient été provoqués par une faute, une négligence ou par un cas de force majeure. Une plainte fondée du client qui a été

introduite à temps (conformément à l’article 6) ne peut donner lieu à une obligation soit de réparer, soit de remplacer (partiellement ou totalement), soit de compléter les biens fournis, sans que BELGIAN DESIGN puisse être tenue en outre à un dédommagement. BELGIAN

DESIGN ne peut être responsable des coûts résultant de travaux supplémentaires ou de retard dans le chef des entrepreneurs lors du placement de produits défectueux.

8. Si BELGIAN DESIGN, à cause de force majeure, se trouve dans l’impossibilité d’exécuter le contrat ou si cette exécution est devenue déraisonnablement difficile, elle se réserve le droit de dissoudre le contrat sans frais ou indemnité, par notification écrite au client. Sont

conventionnellement considérés comme cas de force majeure : guerre, circonstances naturelles, grève ou lock-out, incendie, inondation, saisie, embargo, manque de moyens de transport, pénurie générale de matières premières ou de biens, limitations à la consommation

d’énergie et ce indépendamment du fait si ces circonstances ou le cas de force majeure frappe BELGIAN DESIGN ou un de ses fournisseurs.

9. Tous les produits vendus restent la propriété de BELGIAN DESIGN jusqu’au paiement complet du montant principal, des intérêts et des frais. Pendant cette période, le client ne peut vendre ou donner en gage les biens vendus à des tiers ni en disposer d’une autre manière.

Les risques sont toutefois à charge du client à partir du moment de la disponibilité. En cas de non-respect de cette réserve de propriété et de l’interdiction d’aliénation, les biens vendus sont subrogés par le prix de vente en résultant, et le client est redevable d’une indemnité

forfaitaire égale à 50% du prix de vente.

10. Hormis les exceptions légales, tous les dessins, print, concepts, couleurs, motifs, plans, documents, formulaires, affiches, sites web, … créés par BELGIAN DESIGN et leur contenu ne peuvent pas être reproduits, traduits, adaptés ou stockés, en tout ou en partie, de

quelque manière ou sous quelque forme que ce soit. Leur contenu ne peut pas être communiqué ou distribué au public, de quelque manière ou sous quelque forme que ce soit sans l’autorisation préalable et écrite de BELGIAN DESIGN. Le client garantit qu’il est titulaire de

tous les droits intellectuels sur les dessins, concepts et print qu’il fournit à BELGIAN DESIGN et que leur reproduction par BELGIAN DESIGN ne constitue aucune infraction sur des droits intellectuels de tiers. En cas de violation de ces obligations, le client est redevable à

BELGIAN DESIGN, de plein droit et sans mise en demeure, d’une indemnité de 2.500 EUR par infraction, sans préjudice au droit de BELGIAN DESIGN de réclamer un dédommagement plus élevé.

11. En cas d’annulation d’une commande, même partiellement, BELGIAN DESIGN aura le droit de facturer un montant égal à 30% du prix de la commande annulée avec un minimum de 500 EUR à titre de un dédommagement, sans préjudice au droit de BELGIAN DESIGN de

réclamer un dédommagement plus élevé, notamment le coût des matériaux achetés.

12. Tout litige concernant les présentes conditions générales ainsi que toute autre convention particulière conclue entre BELGIAN DESIGN et le client seront soumis exclusivement aux tribunaux ou la justice de paix compétents du domicile du siège social de BELGIAN DESIGN.

Le droit belge est applicable. L’application de la Convention de Vienne sur la vente internationale est expressément exclue. BELGIAN DESIGN a cependant la faculté de porter les actions en justice devant le tribunal du domicile / siège social du débiteur.

GENERAL TERMS & CONDITIONS BELGIAN DESIGN BVBA/SPRL

1. All commercial transactions between BVBA/SPRL BELGIAN DESIGN (hereinafter referred to as « BELGIAN DESIGN ») and the customer shall be governed by the present General Terms & Conditions. By placing an order with BELGIAN DESIGN, the customer acknowledges

having read and accepted the content of the present General Terms & Conditions. The present General Terms & Conditions take precedence over the general and/or other terms and conditions of the customer, even if these should indicate that they are the only valid terms. The

annulment of any clause of the present General Terms & Conditions shall in no way affect the validity of the other clauses in spite of the annulment of the disputed clause. BELGIAN DESIGN reserves the right to alter the terms of these General Terms & Conditions.

2. Any offer from BELGIAN DESIGN shall not represent any commitments on the part of BELGIAN DESIGN and are valid for one month. The indicated prices as well as the delivery dates are merely indicative. An offer for one order shall not be automatically valid for subsequent

orders. The prices indicated in the offer are valid only if an order is placed for all products indicated in the offer.

3. An agreement between BELGIAN DESIGN and the customer shall only come into effect upon written or electronic acceptance of the customer’s order by BELGIAN DESIGN or by its execution by BELGIAN DESIGN. Any modifications or extensions of an agreement shall only

be valid upon mutual consent of both parties.

4. Unless otherwise agreed, products that are sold by BELGIAN DESIGN are to be picked up in the premises of BELGIAN DESIGN. All costs resulting of the receipt of the products are at the charge and expenses of the customer. All deliveries in the premises of the customer

are at customer’s risks. Delay of deliveries shall never oblige BELGIAN DESIGN to pay any fines or compensations and shall never be a ground for subrogation or dissolution of the agreement at the charge of BELGIAN DESIGN. Modifications of orders automatically annul all

agreed or estimated delivery dates. BELGIAN DESIGN is entitled to charge storage costs.

5. In Belgium the BELGIAN DESIGN prices (unless otherwise notified) are exclusive of VAT and exclusive of delivery, transport, insurance and administration costs. BELGIAN DESIGN reserves the right to adjust the prices during the period of the agreement, within the limits of

the law, to the evolution of her fixed and/or variable costs as a result of a modification in its structure (raw materials, wages, energy, changes in legislation, security measures, …).

Unless otherwise specified on the invoice, all invoices shall be payable in Euro at the registered office of BELGIAN DESIGN, net, and within 30 days of the invoice date. A discount for cash payments can only be accorded when initially expressly agreed. Any amount that remains

unpaid after due date shall be, legally and without prior notice of default, increased by a yearly interest or 12%. In addition, any unpaid invoice shall be increased by a lump sum of 15% of the amount invoiced and remaining unpaid, with a minimum of 75 EUR, without prejudice

to compensation for damages in regard to BELGIAN DESIGN shown to be higher and (judicial) recovery expenses. In so far as the customer remains in default in respect to one or more outstanding payments to BELGIAN DESIGN, the latter shall be entitled to discontinue all

supplies of products or cancel undelivered orders until all outstanding accounts have been cleared. The default of payment of an invoice on its due date, including any interests and penalties due, entails the immediate exigibility of all invoices, including invoices that are not yet

due, and annul all previously agreed payment modalities. The same rule applies in the case of threatening bankruptcy, judicial or conventional dissolution, judicial composition, persistent default of payment, or any other fact proving the insolvability of the customer. In case of

persistent default of payment of the customer, for whatever reason, BELGIAN DESIGN is entitled to put an end to the agreement without any charge or liability and without prior notice of default or intervention of any court, through a letter sent by registered mail to the customer.

The payment by the customer – in whole or in part – of an invoice without any reservations implies approval of the invoice. Payments are always accepted, under reservation of all rights, and are written off first on the judicial costs, then on the interests due, then on the penalty

clause and finally on the principal outstanding amount. BELGIAN DESIGN shall be entitled to make claims for damages against the customer to compensate for any claims made by the customer in regard to BELGIAN DESIGN. The present condition shall be opposable to the

administrator in case of bankruptcy of the customer. Invoices can only be validly challenged by sending a letter by registered mail within eight days from the invoice date indicating the invoice date, the invoice number as well as a detailed justification.

6. Unless otherwise agreed, the customer shall provide through a letter sent by registered mail to BELGIAN DESIGN, (a) within 8 days from the delivery of the products or from the performance of the obligations by BELGIAN DESIGN, in the case of any complaint regarding

visible faults or non-conformity, or (b) in the case of hidden faults, within 8 days of discovering such faults and no later than six months from the date of delivery. Notification of a complaint shall not absolve the customer from the obligation to make payments. No liability for visible

or hidden faults can be sustained by BELGIAN DESIGN if this period has elapsed without receipt of the above-mentioned registered letter. In addition, BELGIAN DESIGN is exempted from any liability as of the transformation, incorporation of the products sold by the customer or

by any third parties, or in case of abnormal or exceptional use or resale of the products sold. By agreement, the short period of time as indicated by article 1648 of the Belgian Civil Code is fixed at 6 months as from the date of delivery.

7. Liability of BELGIAN DESIGN shall be confined to liability which is compulsorily imposed by law. BELGIAN DESIGN shall not be held liable for indirect damage, such as loss of turnover, loss of profit or any rise in general costs. Neither shall BELGIAN DESIGN be liable for any

damages resulting from faults caused directly or indirectly by an action of the customer or third party, regardless of whether this is caused by a fault or omission, or in the case of force majeure.

Justified complaints received in time (in accordance with article 6) from the customer shall result in the substitution (in whole or in part) or supplementation by BELGIAN DESIGN, without any obligation on the part of BELGIAN DESIGN to make additional compensation for

damages. BELGIAN DESIGN shall never be held liable for damages resulting from additional works or delays for the contractors during the placement of defective products.

8. If BELGIAN DESIGN is in the impossibility to execute the agreement or if this execution has become unreasonably difficult, because of force majeure, BELGIAN DESIGN is entitled to terminate the agreement without any charge or liability, through a written notification to the

customer. Are to be considered as circumstances of force majeure: war, natural disasters, strike or lock-out, fire, flood, confiscation, embargo, insufficient means of transport, general scarcity of raw materials or goods, limitations on energy consumption, irrespective of the fact

that the circumstance of force majeure occurs with BELGIAN DESIGN or its suppliers.

9. All products sold shall remain the property of BELGIAN DESIGN until full payment has been made of the principal amount, interests and costs. During this period, the customer shall not sell or pledge the products sold to a third party, or to dispose of the goods in another way.

The risks, however, shall be at the customer’s expense from the time of availability of the products as agreed. If the customer fails to meet the above title retention and prohibition of alienation, the above right automatically passes on the resulting sales price, and the customer

shall pay to BELGIAN DESIGN a compensation equal to 50% of the sales price.

10. Subject to lawful exceptions, all drawings, prints, designs, colors, patterns, themes, plans, documents, leaflets, posters, concepts, websites, … designed by BELGIAN DESIGN may not, wholly or in part, be duplicated, translated, adapted or stored in any form or in any way,

nor may the content, wholly or in part, be communicated or passed on to the public, in any form or in any way, without the prior written consent of BELGIAN DESIGN. The client guarantees that he owns all intellectual rights applicable to the drawings, designs and prints provided

to BELGIAN DESIGN and that their reproduction by BELGIAN DESIGN does not constitute any infringement to third parties’ intellectual rights. In the case of failure to observe these conditions, the customer shall legally and without prior notice of default be liable to pay damages

of 2,500 EUR per infringement to BELGIAN DESIGN, without prejudice to the rights of BELGIAN DESIGN to claim higher damages.

11. Any canceling of the order by the client – wholly or partially – gives BELGIAN DESIGN the right to charge 30% of the price of the canceled order with a minimum of 500 EUR, without prejudice to the rights of BELGIAN DESIGN to claim higher damages, e.g. the cost of the

materials ordered or bought by BELGIAN DESIGN.

12. Any dispute arising from the present General Terms & Conditions, as well as disputes arising from any other agreement entered into by both parties, shall be settled through the competent courts or justice of the place of the domicile of BELGIAN DESIGN, which shall have

exclusive jurisdiction. Belgian Law shall apply. The application of the CISG is expressly excluded. Nevertheless, BELGIAN DESIGN reserves himself the possibility to bring the case before the debtor’s domicile.
